1. About these terms
These terms govern your use of chargedearth.ca and your purchases from Charged Earth Inc., an Ontario corporation based in Eden Mills, Ontario, Canada. By using the site or placing an order you agree to these terms.
2. Products
Charged Earth sells soil supplement products (biochar). Products are sold under the Fertilizers Act (Canada) and the Fertilizers Regulations (C.R.C. c. 666) as registration-exempt supplements. Labels and claims are governed by CFIA Trade Memorandum T-4-130 and safety standards under T-4-93.
Product photography is representative. Packaging and minor appearance may vary batch to batch; guaranteed minimum analysis values on the bag govern.
3. Pricing and payment
- Prices are in Canadian dollars (CAD), exclusive of shipping.
- No GST/HST is charged on orders at this time. If that changes, tax will be shown as a separate line at checkout before you pay.
- Shipping is free to every address we can deliver to in Canada; nothing is added at checkout. Remote and fly-in addresses are quoted individually — see Shipping & Returns.
- Payment is processed by Stripe. We do not see or store your payment card information.
We reserve the right to refuse or cancel orders at our discretion, including cases of suspected fraud, pricing errors, or stock unavailability.
4. Order acceptance
Your order is an offer to purchase. We accept the offer when we ship the product. If we cannot fulfil an order we will issue a full refund and notify you.
5. Shipping, returns, and damaged goods
See Shipping & Returns. Ontario Consumer Protection Act rights are not displaced by this section.
6. Product use and suitability
Our products are intended as soil supplements. Directions for use are on every bag and in our how-to guides. Biochar is suitable for most ornamental and edible gardens; gardeners growing acid-loving plants (blueberries, azaleas) should consult the pH buffering page before using. It is the purchaser’s responsibility to confirm suitability for their specific application.
Do not ingest. Not intended for human or animal consumption. Not a medical product. Follow precautionary statements on the label regarding dust, handling, storage, and keeping out of reach of children.
7. Limitation of liability
To the fullest extent permitted by Ontario law, Charged Earth’s aggregate liability arising from or related to your use of the site or purchase of any product is limited to the amount you paid for the product in question. We exclude liability for indirect, incidental, special, consequential, or punitive damages to the fullest extent permitted.
Nothing in these terms limits any consumer statutory rights that cannot lawfully be excluded, including rights under Ontario’s Consumer Protection Act, 2002.
8. Intellectual property
All content on this website — text, images, logos, product photography, calculators, code — is © Charged Earth Inc. The Charged Earth name and logo are our trade marks. You may link to pages on the site. You may not reproduce or redistribute site content without written permission.
9. User-submitted content
If you submit content (e.g., a product review or photo), you grant Charged Earth a non-exclusive, royalty-free licence to display and adapt that content on our website and marketing channels with attribution to the name you provided. You represent that you own the content and that it does not infringe on anyone else’s rights.
10. Changes to the site or these terms
We may update the site, product catalogue, pricing, or these terms at any time. Changes to terms will be announced on this page with a revised last-updated date.
11. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. The courts of Ontario have exclusive jurisdiction.
